Terms of Service
Effective date: October 17, 2026
These Terms of Service ("Terms") are a binding agreement between you and Jonathan Blake LLC DBA The Lead Venture ("The Lead Venture," "we," "us" or "our"). They govern your use of theleadventure.com, our calculators, assessments, blog and audio, our forms, and our paid Booked Solid System plans and related services (together, the "Services").
Please read these Terms carefully. Section 17 requires most disputes to be resolved by binding individual arbitration and waives class actions and jury trials, unless you opt out as described there.
By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old and able to form a binding contract. If you use the Services for a business, you represent that you are authorized to bind that business, and "you" includes the business.
2. What we provide
The Lead Venture provides marketing and growth services for local service businesses, sold as the Booked Solid System. Depending on your plan, this can include a website and hosting, local SEO and Google Business Profile work, missed-call text-back, review requests, a business mobile app, follow-up and reactivation campaigns, content, an ad system, and sales coaching. Plan features are described on our pricing page and may change over time. Many features run on third-party software, including HighLevel (LeadConnector), Google, Meta and telecom carriers.
3. Plans, setup fee, billing and cancellation
- Plans and billing periods. Paid plans (currently Growth and Full Suite) are subscriptions billed monthly, quarterly, every 6 months or annually, at the prices shown on our pricing page when you sign up. Quarterly, 6-month and annual plans are paid in advance for the full period.
- 10-day free trial. You enter your payment method when you sign up, but nothing is charged during your first 10 days, which is about how long it takes to get your system live. Your first plan payment is charged when the trial ends, and later payments renew from that date. If you cancel before the trial ends, you are not charged.
- Setup fee. Monthly plans include a one-time setup fee (currently $1,000), charged once your build is done and your system is live, for onboarding and system setup. We waive the setup fee when you choose quarterly, 6-month or annual billing. The setup fee is non-refundable once onboarding has started.
- Card processing fee. Payments made by card include a 3% processing fee, shown at checkout before you pay.
- Automatic renewal. Your plan renews automatically each billing period at the then-current price until you cancel. You authorize us and our payment processor to charge your payment method on each renewal.
- No long-term contract. You may cancel at any time by emailing mail@theleadventure.com or through any cancellation method we provide. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- Territory protection. While your subscription is active and in good standing, we will not take on a new client in the same trade whose primary business address is within 30 miles of yours. This does not apply to clients we were already serving when you signed up.
- Founding Member pricing. If you join at a Founding Member rate, we will keep that rate for your plan for as long as your subscription stays active. It does not transfer to a different plan, and it ends if you cancel.
- Refunds. Except as described in Section 4 or where required by law, fees are non-refundable, including for partial billing periods.
- Usage and pass-through fees. Plans cover the platform and features. Telecom and messaging costs are billed separately at cost, including business phone numbers, A2P 10DLC or toll-free registration, and per-message SMS and email fees. Ad spend on Meta, Google or other platforms is paid by you directly to those platforms and is not part of your plan.
- Price changes. We will give you at least 30 days' notice before a price change to your plan takes effect.
- Taxes and failed payments. Prices do not include applicable taxes. If a payment fails, we may suspend the Services until it is paid.
4. Our guarantees
- No-Contract Guarantee. There is no long-term contract and no cancellation fee. You may cancel at any time as described in Section 3.
- Performance Guarantee. If, in your first full month of a paid plan, the Services do not help you generate revenue equal to at least twice the plan fee you paid us for that month, you may choose either (a) we keep providing the Services at no charge until they do, or (b) a refund of the plan fee you paid for that month. To qualify, you must follow our onboarding and setup guidance, including importing your customer and lead contacts, using the business mobile app to respond to leads and manage conversations, keeping missed-call text-back and review requests turned on, completing the setup steps we assign, and sharing the job and revenue information we need to measure results. You must also tell us in writing within 30 days after that month ends. We measure results using the leads, bookings and jobs tracked in your account and the information you provide. This guarantee is limited to the plan fee for that month; it does not cover the setup fee, usage and pass-through fees, or ad spend.
5. Your website, content and data
- Your content and data. You own the content you give us (logos, photos, text, service details) and your customer data. You grant us a non-exclusive, royalty-free license to use, host, modify for formatting and publish it to provide the Services.
- Our platform. We own or license the software, templates, designs, code, automations, calculators and other materials we use to provide the Services. You receive a limited right to use them while your subscription is active.
- Domain names. A domain registered in your name stays yours. If we register a domain for you, we will transfer it to you on request, subject to the registrar's rules and any registration costs.
- Data export. When you cancel, we will provide an export of your contacts, leads and customer history on request.
- Website handoff. If you want us to rebuild and hand off your website on a different platform, there is a one-time transition fee of $1,500, because we rebuild the site on the new platform (for example WordPress). Automations and systems built on our platform (for example appointment reminders, review requests and follow-up sequences) do not transfer and would need to be rebuilt on your new platform.
6. Your responsibilities
You are responsible for your business and how you use the Services. In particular, you agree that:
- Messaging consent. You will only text, call or email people who have given any consent required by law, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM and carrier rules. If you import contacts, you represent that you have the right to contact them. You will honor opt-outs such as STOP right away.
- Accurate registration. Information you give us for A2P 10DLC or other carrier registration is true and complete.
- Reviews. You will not offer incentives for reviews, post fake reviews, or ask only happy customers to leave public reviews. These practices break Google's policies and the FTC's rule on consumer reviews and testimonials.
- Licensing and claims. You hold every license, registration and insurance your trade and area require, and everything we publish for you at your direction (prices, offers, credentials, guarantees) is true.
- Ads. Your ad accounts, ad spend and the claims in your ads are your responsibility and must follow each platform's policies.
- Access. You will give us the access we reasonably need, such as to your Google Business Profile, domain and accounts, and keep your login details secure.
7. No guarantee of specific results
Except for the guarantees in Section 4, we do not guarantee any number of leads, calls, reviews, rankings, traffic, customers or revenue. Results depend on many factors outside our control, including your market, your response time, your sales process, platform changes and competition. Case studies and testimonials on our website describe real results for specific clients and are not typical or guaranteed. No one can guarantee a specific Google ranking.
8. AI features
Some features use artificial intelligence, such as conversational AI that replies to leads, a voice AI receptionist, and the AI-voice narration of our blog posts. AI output can be wrong or incomplete. You are responsible for reviewing how AI features are configured for your business and for any commitments made to your customers. Blog narrations are labeled as AI-generated.
9. Free tools, calculators and content
Our calculators, assessments, playbooks, blog posts, audio and other content are for general information and planning only. They are not legal, tax, financial or insurance advice, and estimates are not quotes or guarantees. Get professional advice for your specific situation.
10. Forms and text messages
When you submit a form on our website, you agree that we may contact you about your request. If you opt in to text messages, message frequency varies and message and data rates may apply. Reply STOP to opt out at any time or HELP for help. Consent to marketing texts is optional and is not a condition of any purchase. Our full SMS Terms explain the program. See our Privacy Policy for how we handle your information.
11. Acceptable use
You agree not to:
- use the Services to send spam or unlawful messages, or for any unlawful purpose;
- submit false or misleading information, or impersonate anyone;
- scrape or bulk-download our content or tools, except as our robots.txt allows search engines;
- interfere with, overload or try to gain unauthorized access to the Services; or
- copy, resell or reverse engineer the Services, except as permitted by law.
12. Intellectual property
The website and Services, including their design, text, graphics, logos, calculators, playbooks, audio and software, are owned by us or our licensors and protected by law. "The Lead Venture," "Booked Solid" and our logos are our marks. Third-party marks belong to their owners.
13. Copyright complaints
If you believe content on our website infringes your copyright, email mail@theleadventure.com with your signature, the work you believe was infringed, where the material appears, your contact information, a statement that you have a good-faith belief the use is not authorized, and a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act for the owner.
14. Third-party services
The Services rely on and link to third-party services, including HighLevel (LeadConnector), Google, Meta, Cloudflare, PostHog, telecom carriers, Home Pros Ohio and Midwest Roof Calculators. We are not responsible for third-party services, their availability or their policy changes, which may affect features. Your use of them is subject to their terms.
15. Disclaimer of warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT MESSAGES WILL ALWAYS BE DELIVERED.
16. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE LEAD VENTURE AND ITS OWNERS, MEMBERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
17. Dispute resolution and arbitration
Informal resolution first. Before filing a claim, you agree to email mail@theleadventure.com with a description of the dispute and to try to resolve it informally for 30 days.
Binding arbitration. If the dispute is not resolved, you and we agree that any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (or Commercial Arbitration Rules for business customers). The Federal Arbitration Act governs this section. Arbitration will take place in Stark County, Ohio, or by video or phone, or as otherwise agreed.
Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for misuse of intellectual property.
Class action and jury trial waiver. YOU AND WE AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE ACTION, AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL.
Opt-out. You may opt out of this arbitration agreement by emailing mail@theleadventure.com with your name and the statement "I opt out of arbitration" within 30 days after you first accept these Terms.
18. Governing law and venue
These Terms are governed by the laws of the State of Ohio and applicable federal law, without regard to conflict-of-law rules. For any claim not subject to arbitration, you and we consent to the exclusive jurisdiction of the state and federal courts located in Stark County, Ohio.
19. Indemnification
You agree to defend, indemnify and hold harmless The Lead Venture and its owners, members, employees and contractors from claims, losses and expenses (including reasonable attorneys' fees) arising from your use of the Services, your content, the messages you send, your violation of these Terms or any law, or the services you provide to your customers.
20. Suspension and termination
We may suspend or end the Services if you breach these Terms, fail to pay, or use the Services in a way that risks harm to us, carriers or others, including messaging without consent. Sections that by their nature should survive termination will survive.
21. Changes
We may update these Terms by posting a new version with a new effective date. If changes are material, we will give reasonable notice. Continued use after the effective date means you accept the updated Terms.
22. General
These Terms and the Privacy Policy, together with any order form or written agreement for your plan, are the entire agreement about the Services. If an order form conflicts with these Terms, the order form controls. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. You consent to receive notices electronically.
